Washington Consumer Health Data Privacy Policy

This notice supplements our main Privacy Policy and applies specifically to residents of the State of Washington regarding "consumer health data" as defined under the Washington My Health My Data Act (MHMD Act), RCW 70.372.

1. Categories of Consumer Health Data We Collect

EatnFit collects the following categories of consumer health data about Washington residents:

• Body measurements: weight, height, BMI, and body composition data you enter
• Dietary and nutritional data: food logs, caloric intake, macronutrient tracking
• Metabolic indicators: basal metabolic rate estimates and related metabolic health metrics
• Activity and fitness data: physical activity levels and exercise logs you enter or sync from connected devices
• Food photos: images of meals you submit for AI nutritional analysis
• Health goals: weight management, nutrition, and metabolic health objectives
• Device and sensor data (if applicable): data synced from connected health devices or platforms (e.g., Apple HealthKit, Google Health Connect) where you grant permission

2. How We Collect This Data

We collect consumer health data:

• Directly from you: through manual entry in the App, photo submissions, and profile setup
• From connected services: with your explicit authorization, from Apple HealthKit, Google Health Connect, or other third-party health apps you choose to connect
• Automatically: through your use of the App's features (e.g., meal logging activity)

3. How We Use Consumer Health Data

We use consumer health data to:

• Provide, operate, and improve the EatnFit App and its AI-powered features
• Generate personalized nutritional insights and recommendations
• Maintain your meal history and metabolic tracking records
• Improve and train our AI models (using anonymized, aggregated data only — we do not use your identified health data for model training without separate explicit consent)
• Conduct internal analytics and research to improve product quality
• Comply with applicable legal obligations

We do not use your consumer health data for:

• Targeted advertising based on health attributes
• Sale or sharing for third-party marketing purposes

4. How We Share Consumer Health Data

We may share consumer health data in limited circumstances:

• AI processing providers: Food photos and meal data are transmitted to AI technology partners to perform nutritional analysis. These partners are contractually limited to processing data solely for this purpose.
• Cloud infrastructure: Data is stored using secure cloud platforms (e.g., Firebase / Google Cloud, AWS) under data processing agreements.
• Legal requirements: As required by law, court order, or valid governmental request.
• Business transfers: In the event of a merger, acquisition, or asset sale, with appropriate notice to you.
• With your consent: For any other purpose with your explicit prior consent.

We do not sell your consumer health data.

5. Your Rights Under the Washington My Health My Data Act

As a Washington state consumer, you have the following rights with respect to your consumer health data:

• Right to Confirm: Confirm whether we are collecting or sharing your consumer health data
• Right to Access: Obtain a copy of the consumer health data we hold about you
• Right to Deletion: Request deletion of your consumer health data, subject to certain exceptions required by law
• Right to Withdraw Consent: Withdraw previously granted consent for the collection or sharing of your consumer health data
• Right to Appeal: Appeal any denial of your rights request (see Section 7 below)

6. How to Exercise Your Rights

We will respond to your request within 45 days. If we need additional time (up to 45 additional days), we will notify you in writing with the reason for the extension.

We may ask you to verify your identity before processing your request. We will not discriminate against you for exercising your rights.

7. Appeals Process

If we deny your rights request, you may appeal by contacting us at:

Please include a reference to the original decision you are appealing. We will respond to your appeal within 45 days. If we deny your appeal, we will provide you with information on how to contact the Washington State Attorney General to submit a complaint.
